ActivTrades Affiliate Program

These Terms & Conditions (“Ts & Cs”) govern the ActivTrades Affiliate Program. Taking part in the Program constitutes acceptance of the Ts & Cs. The Program is open for as long as ActivTrades continues to maintain the Program within www.activaffiliate.com .

Affiliate

“Affiliate” shall mean the individual or entity which applies for membership of the affiliate program following the terms and conditions set forth herein and agrees with and accepts these terms and conditions and is approved by the Company for membership of the program.

“Tracking URL” is a unique hyperlink to our Website that we issue to an affiliate when it is approved to be an Affiliate. The Tracking URL enables us to link the affiliate to the clients that you’ve referred to us, so that we can accurately calculate your Fees.

Customer Definition

“Qualified Client” means a client that an affiliate direct to our Website(s), as identified by its Affiliate ID, who meets our criteria.

Qualified Clients must reside in a country from where we accept Affiliate referrals, make a first-time deposit of at least $100, generate spread revenue in excess of USD 40 for ActivTrades within the first 180 days of making the deposit, and not already be registered as a client with AT.

Referral Fees

Fees will be calculated based on the Client activity linked to the Affiliate ID or linked to the Affiliate ID of which we identify via Affiliate’s Tracking URL or sign up bonus codes issued to it. We will pay a fixed CPA fee for each Qualified Client depending on the country of residence of the client. A table outlining this Fee Structure is contained in https://activaffiliate.com/cpa-rates .

Fees will be paid monthly in arrears, subject to satisfactory verification (where relevant), to an active ActivTrades Affiliate Account in the affiliate name.

Changes

ActivTrades may change any of these Terms by providing its affiliates with at least 7 days’ written notice. The notice must explain the general nature of the changes and enclose a copy of the updated Terms with the changes included.

Electronic Communications

In relation to any e-mails, all websites, including affiliate’s website, links to websites, and generally anything written that assists in the solicitation and introduction of a client, an affiliate must comply at all times with the UK’s Data Protection Act 2018, the EU’s General Data Protection Regulation 2016/679, and any other applicable local, state, federal and international laws, rules and regulations pertaining to the use of unsolicited electronic communications when sending electronic communications.

Privacy Policy

ActivTrades will comply at all times with our Privacy Policy, located here of this Website ActivAffiliate website, in relation to any personal information that an affiliate share with AT under these Terms.

Applicable law and Dispute Resolutions

This legal notice shall be governed by and construed in accordance with English law. Disputes arising in connection with this legal notice shall be subject to the exclusive jurisdiction of the English Courts.

Termination

Either party can terminate this Agreement by providing the other party with at least 7 days’ written notice. We reserve the right to terminate the agreement unilaterally, cancel any payment due and retain any such fees agreed if we find an affiliate is taking unfair advantage, acting in bad faith or is trying to abuse any of the terms or it is found to be in breach of any of the terms of the Agreement.

Warranties

The Affiliate warrants and undertakes

• that it shall use its best endeavors to introduce clients to ActivTrades, including through the use of such means and methods as described detailed by us,
• that it has and will maintain for the Term of the Agreement with ActivTrades,
• that it has and will continue to comply with all applicable laws, regulations, rules and other similar instruments as are in force from time to time and which are binding on either or both of the Parties;
• that it has and will continue to be fit and proper to undertake its obligations under the agreement; and
• that it will not be in breach of any duty or obligations with any third party when performing its obligations under the agreement.

Notice

Affiliate agrees that all communications between it and us in relation to the Affiliate Program will be by email, unless another method is agreed to by it. Any notice or other communication to or by a party by email is regarded as being given by the sender and received by the addressee at the time it was sent, unless the sender receives a delivery failure notification indicating that the email has not been delivered. If the delivery or receipt is after 5.00pm (addressee’s time) it is regarded as received at 9.00am the following Business Day (being a day which is not a public holiday or a weekend in the United Kingdom).
